Terms of Use & Privacy Policy

Service Level Agreement entered between My Wedding Online hereinafter referred to as the” Service provider/SP”) and the undersigned (hereinafter referred to as the “User”) based on the Terms and Conditions set out hereunder which terms and conditions will govern the use of the website and purchase and use  of any of the products offered on the website:

 

Terms and Conditions

“Website” means  www.mywedding.online. Which includes all links and products which appear on the website.

“Acceptance of Terms” shall mean acceptance of these terms and conditions in its entirety, and the time of acceptance will be the time of registering an account and submission of all personal details as set out hereunder.

By submitting the details the user acknowledges that he /she understands the terms and conditions and accepts same as binding.

‘User” includes only natural persons, whom, by acceptance of these terms and conditions, agree to be bound to the SP to meet all obligations set out herein.

‘’Products’’ are the packages as more fully described in annexure A hereunder which will, upon selection by the User, be incorporated into these terms and conditions

The user furnishes as his/her domicilium citandi et executandi address, email address and or contact details mentioned hereunder as the address at which he/she will accept notices and other process.

The products may be utilized by the User, subject to these terms and conditions.  The User acknowledges that the entire site content, including all jingles, advertisements for sponsors and any other content as produced by and received from the SP are the property of the SP and remain the property of the SP. The user may not sell, re-produce, publish, transmit or in any way encumber the products, programming or any other product downloaded or utilized from the website of the SP.

The User must present the products in the form agreed with the SP and as prescribed by the product package, and may not in any way adapt, change, edit, reproduce or amend the product content in any way, save for changes included in the product purchase. The User acknowledges that the SP may advertise the names and details of certain sponsors or entities as part of the product content. The User warrants that he/she will not broadcast any advertisements, jingles or any other marketing material referring to the said sponsor in undiluted form. Although the SP will take every care to ensure that the product content is of the highest quality, and to produce and deliver the programming timeously, the User agrees to indemnify and hold the SP harmless from any claims for damages suffered as a result of any defect in and to the content, its quality or the late delivery of the product to the user .The User acknowledges that he/she is fully aware of the content prior to broadcasting same. The SP does not accept responsibility for any opinions expressed in the products. The SP does not give any warranties regarding the products or any other content to the User. The User downloads and utilize the products  from the SP’S website at his/her own risk and will ensure that his/her hardware is properly protected against any viruses etc. and that they have the necessary software needed to download the products .

The User certifies that all personal information is furnished voluntarily and that he/she is fully aware of the purpose for furnishing such personal information to wit: the conclusion of a legal and binding agreement with the SP. The User agrees to make available to the SP any statistics or information related to the products and its distribution, within seven (7) days from receiving such request in writing and further agrees that such statistics may be used by the SP. The User further certifies that he/she will obtain the necessary consent from recipients of any of the products and that  the recipients’ details are furnished voluntarily and that the purpose for requesting such information will be clearly explained to the recipients as required by the Protection of personal information Act. The User indemnifies the SP fully against any claims which may arise from any contravention of the Protection of personal information Act.

If the User is not satisfied with the products or service the SP will supply the User with a once off new profile and package equivalent to the original package purchased by the User or an 80% refund of monies spend on the website. Monies will not be refunded by the SP in the case of a cancellation of event/wedding, change of date or if the invitations has already been send to guests.

Force Majeure Events means any event or circumstance, or combination of events or circumstance, beyond the reasonable control of the SP occurring on or after the date on which the agreement has been entered into by the User. If by reason of a Force Majeure Event and the SP is wholly or partially unable to perform its obligations under this agreement, the SP shall notify the User of the Force Majeure Event within 72 hours after the SP has become aware of the occurrence of that Force Majeure Event, describing that Force Majeure Event in reasonable details and, to the extent that it can be reasonably determined at the time of the notice, a preliminary evaluation of the obligations affected and a preliminary estimate of the period of time that the SP will be unable to perform the obligations.

Upon the occurrence of the Force Majeure Event and the effect thereof the SP shall not be liable for any failure or delay in performing its obligation under the agreement to the extent that such a failure or delay in performance has been caused by or contributed to such Force Majeure Event or its effect or by any combination thereof and the time limits and deadlines for the performance by the effected SP of its obligations under this agreement, which are affected by such Force Majeure Events  shall be extended day- for-day for as long as the affected SP is unable to perform, or is delayed in performing, such obligations because of the occurrence of, or the effect of, such Force Majeure Event. The SP shall not be held liable for any loss or damage suffered by the User as a result of a Force Majeure Events or its effect.

The parties agree that the Law of South Africa will be applicable in the event of any dispute. The parties further agree to the Jurisdiction of the High Court of South Africa (Gauteng Provincial Division) to institute any action or make application which stems from this agreement.

The parties agree that these terms and conditions ,including Annexure A, constitute the entire agreement between them, and that no amendments will be of any force and effect unless it is reduced to writing and signed by both parties ,save to exclude the SP’S discretionary changes as set out above.      

The Parties agree that these terms ,together with selection of the relevant package as set out in annexure A will constitute the entire offer of the SP to the User which the User unconditionally accepts by clicking on the ‘’Accept’’ icon hereunder.

Security Password protection

My Wedding Online and Picksmart have built a secure data platform to keep User passwords safe. The payment portal Pay U has strong security measure and standards that they have to adhere to be able to deliver his/her services. But User must take care not to lose his/her passwords.

Custom domain name

This feature is only available on the Platinum all inclusive package and lets the User create his/her own custom URL name for example (www.JohnandLia.co.za). Custom domain names are subject to availability as per the User’s name selection.

User can send customized or default sms’s to all or selected guests form the backend of his/her website. User can also buy more Sms bundle if needed for the Silver, Gold and Platinum Packages.

      = design of user's website of max 6 working hours and 2 working hours for amendments

      = upload of user's guest to guest-list from the website guest list excel sheet that can be downloaded from the user's website

      = the user must provide the SP with adequate, complete and up-to-date guest information

    = the SP takes not responsibility if the wrong information is loaded on to the user's website as it is the users responsibility to forward             the correct guest information.       

 

The Parties agree that these terms ,together with selection of the relevant package as set out in annexure A will constitute the entire offer of the SP to the User which the User unconditionally accepts by clicking on the ‘’Accept’’ icon on registration.
